In a sale deed, a person certifies their entitlement to a specific property. Sale deeds, as their name suggests, are essential documents to have when a property is being sold or transferred, as they provide important information to the purchaser. A duplicate copy of the document is provided in the event that it is lost or misplaced, due to its importance. This article explains how to obtain a duplicate copy of this vital document for a seller of a property.
The following prerequisites must be followed
An owner can obtain a duplicate deed without an original copy if he or she provides a bond of indemnity. The following requirements must be met in order to obtain it:
FIR filing
The first step is to file an FIR (First Information Report) with the necessary information like document registration number and details of ownership, at the nearest police station. The police would issue a non-traceable certificate to the concerned person if they were unable to recover the documents. The non-traceable certificate will come in handy when applying for a duplicate copy.
The Supreme Court has directed all police stations to post First Information Reports (FIRs) filed by complainants on their respective websites. As a result, the concerned person could view online details of the FIR and its status.
Print Notification
Applicants are also required to place advertisements in two newspapers (one in a local and one in an English publication). In the advertisement, it should be specified that the documents have been lost and that any claim over the property should be invited. No claims must be received within the specified time-frame without a letter of recommendation from an advocate.
Affidavit Formulation
It is necessary to file an affidavit on stamp paper when an important document is lost or misplaced and hasn’t been found within a reasonable time frame. Affidavits must include information about the lost sale deed and other relevant documents along with a notary’s signature, attestation, and registration. In addition to the Affidavit, the applicant can attach the FIR documents and copies of newspaper advertisements.
Duplicate copy issue
A duplicate copy of the certificate can be obtained by submitting a copy of the FIR, copies of the advertisements published, a copy of the affidavit, and an application requesting a copy of the sales deed to the respective sub-registrar’s office. There is a prescribed fee for these documents, which varies from location to location. For the sale of a property and other relevant purposes, the duplicate copy can replace the original.
The deed also serves other purposes
The sale deed is used not only for conducting transparent sales, but also for obtaining loans for the purchase of a property. If the original sale deed is missing, banks may request copies of the deed, affidavits, etc. in order to process the loan.
